A businessman suspected of having fraudulently acquired Ksh11.6 million from his client to import vehicles for him will be held up in police custody for 10 more days.
In an affidavit presented before the Milimani Court by the Investigative officer Sammy Shamalla, he requested the court to give orders for the accused to be held for 10 days to conclude investigations.
The suspect Daniel Mwaura Hinga is said to have received Ksh11.6 million from Eugene Oigara by duping that he was in a position to import two cars for him.
The court heard that the accused assured to import a BMW M3 vehicle valued at Ksh3,920,000 and received more Ksh3,400,000 for purchasing another BMW X3.
The court further heard that the accused met the complainant online trading with Driveline Motors Limited a company he used to defraud Oigara and it closed their offices which were based at Two Rivers.
The alleged offence took place on diverse dates between May 30 and July 20 2023, in the Westlands area within Nairobi county.
The accused was arrested yesterday and held at Parklands police station.
In the affidavit, the complainant says he later sought the suspect’s assistance to help him in the clearance of a Land Rover Defender which was at the port in Mombasa. He would later send him Ksh4,340,000 which he instead used for his personal gain.
The officer told the court that he needed more time to investigate while the accused was in custody since feared interfering with the witnesses.
“Upon receiving the money from the complainant he diverted it to purchase his personal vehicles where we fear he will interfere with the exhibit,” the officer said.
The officer told the court that the accused has conducted a series of frauds against the public as a car dealer and has a similar case pending.
The magistrate Wandia Nyamu granted the orders for the accused to be held for 10 days.
The matter will be mentioned on September 5, 2023.
