Hon Lady Justice Grace Nzioka is expected to deliver her Judgement on 12th March 2024.
In December 2021 the DPP filed an appeal at the high Court challenging the lower court’s decision as they were dissatisfied with the same.
The five car theft syndicate including a woman were jointly charged for stealing a newly imported MV Toyota Fielder valued at Kshs. 1.25 million in September 2016.
Sources reaching our desks indicate that the five were mysteriously acquitted despite massive evidence tabled in court against them.
On 27th November, 2020 SCM Abdulkabir Lorot made a ruling on the case which read in part “I have gone through all the evidence on record.
In particular, I have considered the detailed submissions at this stage of the trial received from both sides. I find that there is a prima facie case made out against the accused persons.
Accordingly, they are place on their defense to conform to S. 211 of the C.P.C.”
According to the court proceedings, the accused persons were placed on their defense after the prosecution called 15 witnesses who testified in the case.
The five charged persons David Ronoh, Titus Namuye Buluma, Robert Kiprotich Bett, Judy Nyambura Ndichu and Joel Wanda who were acquitted at Kibera law courts in 2021 will know their fate by next week.
