Exclusive; Former Nairobi Provincial Commissioner Davis Nathan Chelogoi charged with Sh 1.3Million Land Fraud

Former Nairobi Provincial Commissioner (PC) Davis Nathan Chelogoi has been charged with Sh 1.3 billion land fraud.

Chelogoi is charged alongside Andrew Aseri Kirungu with conspiracy to defraud Ashok Rupshi Shah and Hitenkumar Amritlal Raja land Reference No. 18485 I.R No.64011/1 measuring 7.390 hectares.

The said property is located along Lower Kabete road and is estimated to be worth Sh 1.3 billion.

The two are alleged to have committed the offence on or before the 9th December 2020 within the Republic of Kenya, jointly with others not before court.

The two are also charged with obtaining registration of the said land by false pretences.

The court heard that on diverse dates between 9th December 2020 and 4th June 2021 at the State Department of Lands and Physical Planning within Nairobi City County jointly and unlawfully with intent to defraud, procured registration by falsely pretending that Chelogoi is the lawful and the registered owner of the said land.

Kirungu further a solo charge of abuse of office for allegedly causing fraudulent Certificate of Title L.R. No.18485 I.R. No.232908 to be made by the office of the Chief Land Registrar for the purpose of gain, in abuse of the authority of his offices, an arbitrary act prejudicial to the rights of Shah and Raja.

He is alleged to have committed the offence on diverse dates between the 9th December 2020 and 26th May 2021 at the State Department of Lands and Physical Planning within Nairobi City County, being a person employed in the public service as an Assistant Deputy Director Land Administration Officer in the State Department of Lands and Physical Planning.

Kirungu is currently out on bail who is already out on bail after pleading to the charges while Chelogoi was unwell.

Chelogoi is also charged with forcible detaining of the said property in a manner likely to cause a breach of the peace or reasonably apprehension of breach of peace against Shah and Raja who are entitled by law to possession of the said land.

In addition, the former PC is facing charges forging a letter of allotment for the said land, signature and a stamp impression for a land registrar and uttering a forged document.

He denied the charges before Senior Resident Magistrate Dolphina Alego.

Chelogoi will remain in custody until Monday 24th March 2024 when the court will deliver the ruling on opposition of bail.
